San Bernardino  DUI Criminal Defense Attorney

Department of Motor Vehicles (DMV) Hearings

If you have been arrested in Rancho Cucamonga or San Bernardino Counties for suspicion of Driving Under the Influence (DUI) then you must within 10 days after your arrest contact and make an appointment with your local DMV office to schedule a DMV administrative hearing (APS).  If you have hired an attorney or plan on hiring a criminal defense attorney then they can make this appointment on your behalf.

Once an individual is arrested in Rancho Cuamonga or San Bernardino counties for Driving Under the Influence (DUI), the arresting officer will immediately take the arrested persons license and provide the arrested individual with a temporary license. The temporary license is good for 30 days. After the 30 days, the temporary license will expire unless a DMV hearing is scheduled within 10 days after the arrest for Driving Under the Influence (DUI).

Once someone is arrested for Driving Under the Influence (DUI), this event automatically triggers a civil charge as to your driving privileges. This hearing is called a California DMV Hearing. The hearing is used to determine the driving rights of the arrested. An individual that has been arrested for Driving Under the Influence (DUI) may be subjected to having their license restricted, revoked, or suspended due to the Driving Under the Influence (DUI) charge.

If you fail to request the hearing within 10 DAYS you forfeit your right to a DMV hearing!
